Welcome to Busty & Beyond (formerly La Plantureuse). These Terms of Service (“Terms”) govern your use of our website (bustyandbeyond.com), your purchase of our products, and your participation in our B&B Insiders community.

By accessing our website, making a purchase, or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

1. GENERAL TERMS

A. Agreement to Terms

By using bustyandbeyond.com, you confirm that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into a binding contract
  • You will comply with these Terms and all applicable laws
  • All information you provide is accurate and current

B. Changes to Terms

We reserve the right to modify these Terms at any time.

How we notify you:

  • Material changes: Email notification to registered users at least 30 days before changes take effect
  • Minor changes: Updated “Last Updated” date at the top of this page

Your continued use of our website after changes constitutes acceptance of the modified Terms.

A. Permitted Use

You may use our website for:

  • Making purchases for personal, non-commercial use
  • Joining our B&B Insiders community
  • Contacting customer support
  • Accessing educational content about bra fitting and sizing

B. Prohibited Use

You may NOT use our website to:

Illegal Activities:

  • Violate any local, state, national, or international law
  • Engage in fraudulent transactions or identity theft
  • Use stolen credit cards or payment information

Harmful Activities:

  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our website or servers
  • Use automated systems (bots, scrapers) without permission

Intellectual Property Violations:

  • Copy, reproduce, or distribute our content without permission
  • Use our trademarks, logos, or brand name without authorization
  • Reverse engineer or attempt to extract source code

Abusive Behavior:

  • Harass, threaten, or abuse our team members or other customers
  • Submit false or misleading information
  • Create multiple accounts to abuse promotions or policies
  • Resell our products commercially without authorization

Violation Consequences:

  • We reserve the right to suspend or terminate your account
  • We may refuse service or cancel orders
  • We may pursue legal action for damages

C. Account Registration

If you create an account:

  • You are responsible for maintaining confidentiality of your password
  • You are responsible for all activities under your account
  • You must notify us immediately of unauthorized access
  • You may not share your account with others
  • You must provide accurate and complete information

Account Termination:

  • You may close your account at any time by emailing hello@bustyandbeyond.com
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, you lose access to order history and saved information

3. PRE-ORDER TERMS

All current products are offered as pre-orders. By placing a pre-order, you understand and agree to the following:

  • Payment is collected in full at checkout. You are paying for a product that will be manufactured and shipped on the estimated date shown on the product listing.
  • The estimated ship date is displayed on the product listing and in your order confirmation email. Busty & Beyond has a reasonable basis for every estimated ship date we provide.
  • You may cancel your pre-order at any time before it ships for a full refund to your original payment method within 7 business days of your request.
  • If we are unable to ship by the estimated date, we will notify you immediately by email with a new estimated date and a reminder of your right to cancel.
  • If your order is delayed more than 30 days past the original estimated ship date and you do not respond to our delay notice, your order will be automatically cancelled and fully refunded within 7 business days. You will not be charged any cancellation fee.

These pre-order terms are provided in compliance with the FTC’s Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435).

4. PRODUCTS & PRICING

A. Product Information

We strive for accuracy, but:

  • Product descriptions, images, and specifications are provided for general information
  • Colors may vary slightly due to screen settings and photography
  • We do not warrant that product descriptions are 100% accurate, complete, or error-free
  • We reserve the right to correct errors or update information at any time

Sizing Information:

  • We provide detailed measuring guides and size charts
  • Sizing is based on body measurements, not clothing size labels
  • Fit may vary by style (full coverage, t-shirt, strapless)
  • We offer fit consultations to help you find your correct size
  • If you’re unsure of your size, contact us at hello@bustyandbeyond.com before ordering — we’ll help you

B. Pricing

All prices are:

  • Listed in U.S. Dollars (USD)
  • Subject to change without notice
  • Exclusive of applicable taxes (added at checkout)
  • Exclusive of shipping costs (calculated at checkout)

Price Errors:

  • If we discover a pricing error after you’ve placed an order, we will notify you immediately
  • You may choose to complete the purchase at the correct price or cancel for a full refund
  • We are not obligated to honor incorrect prices

Promotions & Discounts:

  • Promotional codes and discounts are subject to specific terms and expiration dates
  • Only one promotional code per order unless otherwise stated
  • Promotions cannot be combined with other offers unless explicitly allowed
  • Promotions cannot be applied retroactively to past orders
  • We reserve the right to modify or cancel promotions at any time

C. Product Availability

Inventory:

  • Products are subject to availability
  • We do not guarantee that products will be in stock
  • If an item is out of stock after you order, we will notify you and offer alternatives or a refund

Discontinued Products:

  • We reserve the right to discontinue products at any time
  • Discontinued items may not be available for exchange or warranty replacement

5. ORDERS & PAYMENT

A. Placing an Order

When you place an order:

  • You are making an offer to purchase products
  • We reserve the right to accept or decline your order
  • Order confirmation email does not constitute acceptance — acceptance occurs when we ship your order

We may refuse or cancel orders if:

  • Products are unavailable or out of stock
  • Pricing or product information is inaccurate
  • We suspect fraudulent or unauthorized transactions
  • Your payment method is declined
  • You have violated these Terms or our policies

B. Payment Methods

Accepted Payment Methods:

  • Credit cards: Visa, Mastercard, American Express, Discover
  • Debit cards with credit card logos
  • Shop Pay, PayPal, Apple Pay, Google Pay

Payment Processing:

  • Payments are processed securely through Shopify’s PCI-DSS compliant infrastructure
  • We do not store full credit card numbers
  • You authorize us to charge your payment method for the total order amount (including taxes and shipping)

Declined Payments:

  • If your payment is declined, we will notify you
  • Your order will not be processed until payment is successful

C. Taxes

  • Sales tax will be charged where required by law
  • Tax rates are based on your shipping address
  • Louisiana customers are charged state rate (5%) plus applicable parish rates
  • You are responsible for any additional taxes or duties

D. Order Confirmation & Changes

Order Confirmation:

  • You will receive an email confirmation after placing your order
  • Confirmation includes order number, items, pricing, and shipping address
  • Review immediately and contact us if any information is incorrect

Order Changes:

  • Contact us immediately at hello@bustyandbeyond.com if you need to change your order
  • We will accommodate changes if the order has not yet shipped
  • Once shipped, changes cannot be made (use our return/exchange policy instead)

Pre-Order Cancellations:

  • You may cancel your pre-order at any time before it ships by emailing hello@bustyandbeyond.com
  • Refunds for cancelled pre-orders are processed within 7 business days

6. SHIPPING & DELIVERY

A. Shipping Methods & Costs

Domestic Shipping (U.S. only):

  • Standard Shipping: $[RATE] for orders under $100
  • Free shipping on orders $100 and over
  • We do not offer international shipping at this time

B. Processing & Delivery Times

Pre-Order Processing:

  • Pre-order estimated ship dates are displayed on the product listing and in your order confirmation email
  • You will receive a shipping confirmation with tracking number when your order ships

Standard Delivery (once shipped):

  • Estimated 3–7 business days depending on location
  • Delivery times are estimates, not guarantees
  • We are not responsible for carrier delays

Tracking:

  • You will receive a tracking number via email when your order ships
  • Contact us if tracking shows no movement for 5+ business days

C. Shipping Address

  • Provide accurate and complete shipping address at checkout
  • We are not responsible for orders shipped to incorrect addresses you provided
  • Contact us immediately at hello@bustyandbeyond.com if you need to update your address before shipment

D. Lost or Damaged Packages

Lost Packages:

  • If tracking shows delivered but you did not receive the package, contact us within 7 days
  • We will investigate with the carrier and arrange a replacement or refund if confirmed lost

Damaged Packages:

  • If contents are damaged, photograph the damage and contact us within 48 hours
  • We will arrange a replacement or refund

7. RETURNS, EXCHANGES & REFUNDS

Our Love It or Your Money Back Guarantee

We stand behind The Minimalist completely. You have 30 days from the date of delivery to wear your bra and decide if it works for you. If it doesn’t — for any reason — we will make it right.

This is not a fine-print policy. It is a commitment.

A. Return Window

30 days from delivery date for returns and exchanges.

B. How to Start a Return or Exchange

Email hello@bustyandbeyond.com with:

  • Your order number
  • What you’d like to return or exchange
  • A brief note on what didn’t work (appreciated but not required)

We’ll respond within 2 business days with a return authorization number. Do not ship items back without a return authorization.

C. Exchanges

  • We’ll help you find the right size or style
  • Contact us at hello@bustyandbeyond.com and we’ll walk you through the exchange process
  • If your replacement item is a different price, we’ll charge or refund the difference

D. Refunds

  • Processed within 5–7 business days of receiving your returned item
  • Refunded to your original payment method
  • Original shipping charges are non-refundable unless the return is due to our error

Pre-Order Cancellation Refunds:

  • Processed within 7 business days of cancellation request
  • Full refund, no cancellation fee

E. Defective or Incorrect Items

  • If you received a defective item or the wrong item, contact us immediately at hello@bustyandbeyond.com
  • We’ll cover return shipping and send a replacement or full refund — your choice

F. Non-Returnable Items

  • Items marked “Final Sale” at the time of purchase
  • Items returned after 30 days from delivery

G. Sizing Disclaimer

We provide a detailed measuring guide and are always available to help you find your size before you order. We strongly encourage you to measure before purchasing. Our guarantee covers you if the fit isn’t right — but we’d rather help you get it right the first time. Reach out at hello@bustyandbeyond.com before you order.

8. INTELLECTUAL PROPERTY RIGHTS

A. Our Intellectual Property

We own or have rights to:

  • Busty & Beyond name, logo, and branding
  • Website content (text, images, graphics, videos)
  • Product designs, patterns, and technical specifications
  • Photography and product images
  • Educational materials (measuring guides, fit guides, blog posts)

Our intellectual property is protected by copyright, trademark, and other laws. Unauthorized use is prohibited and may result in legal action.

B. Your Limited License

We grant you a limited, non-exclusive, non-transferable license to:

  • Access and use our website for personal, non-commercial purposes
  • View and print content for personal reference
  • Share links to our website on social media

You may NOT:

  • Reproduce, distribute, or publicly display our content without permission
  • Use our content for commercial purposes
  • Modify or create derivative works from our content
  • Remove copyright or trademark notices

C. User-Generated Content

If you submit content to us (reviews, testimonials, photos, feedback):

  • You grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display your content for marketing and promotional purposes
  • You represent that you own or have rights to the content you submit
  • You consent to our use of your content as described

If you want us to remove your content, email hello@bustyandbeyond.com. We will make reasonable efforts to remove it.

9. WARRANTIES & DISCLAIMERS

A. Product Warranty

We warrant that our products are made from quality materials and free from defects in materials and workmanship under normal use.

Warranty Coverage (30 days from delivery):

  • Defective seams, stitching, or construction
  • Fabric defects under normal wear
  • Hardware failures (hooks, adjusters, closures)

Warranty Exclusions:

  • Normal wear and tear
  • Damage from misuse or improper care
  • Products purchased from unauthorized sellers

Warranty Remedy: Replacement product or store credit. Contact hello@bustyandbeyond.com with photos of the defect.

B. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, our website and products are provided “AS IS” without warranties of any kind. We do not guarantee:

  • Perfect fit for every body (we provide measuring guides and fit consultations to help)
  • Uninterrupted or error-free website access
  • That product descriptions are 100% accurate at all times

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

We are NOT liable for indirect, incidental, special, or consequential damages arising from your use of our website or products, including lost profits, lost data, or emotional distress — even if we have been advised of the possibility of such damages.

Cap on Liability: Our total liability to you for any claim shall not exceed the amount you paid for the product(s) in question.

Exceptions: This limitation does not apply to death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Busty & Beyond, Amanda Henson, and our employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Your use of our website or products
  • Your submission of content (reviews, photos, testimonials)
  • Your fraudulent or illegal activities

12. DISPUTE RESOLUTION

A. Informal Resolution

Before filing any legal action, you agree to:

  • Contact us at hello@bustyandbeyond.com describing the dispute
  • Provide us 30 days to attempt to resolve the issue informally

Most disputes can be resolved through direct communication.

B. Governing Law

These Terms are governed by the laws of the State of Louisiana, United States, without regard to conflict of law principles.

C. Jurisdiction & Venue

Any legal action must be brought in state or federal courts located in Tangipahoa Parish, Louisiana. You consent to personal jurisdiction in these courts.

D. Class Action Waiver

You agree to bring claims only in your individual capacity. You waive the right to participate in class actions or representative actions.

E. Time Limit for Claims

You must bring any claim within one (1) year of the date the claim arose. After one year, the claim is permanently barred.

13. TERMINATION

A. Your Right to Terminate

You may stop using our website at any time. To close your account, email hello@bustyandbeyond.com.

B. Our Right to Terminate

We may suspend or terminate your access immediately, without notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse our policies (excessive returns, chargebacks, etc.)
  • Harass or threaten our team or other customers

C. Surviving Provisions

Upon termination, the following sections remain in effect: Intellectual Property Rights, Warranties & Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution.

14. PRIVACY & DATA PROTECTION

Your privacy is important to us. Our Privacy Policy (bustyandbeyond.com/privacy-policy) explains what information we collect, how we use it, and your rights.

  • We do not sell your personal information
  • We use information to process orders and improve products
  • You have rights to access, correct, and delete your information
  • We comply with applicable privacy laws

15. ACCESSIBILITY

16. FORCE MAJEURE

During force majeure events, you may cancel affected orders for a full refund.

By joining B&B Insiders, you agree to receive email updates and exclusive offers. You may unsubscribe at any time by clicking “Unsubscribe” in any email.

B. SMS Marketing

If you opt in to SMS messages:

  • Standard message and data rates apply
  • Opt-out: Reply STOP to any message

C. Measuring Kits & Fit Consultations

  • Measuring kits and fit consultations are provided to help you find your size
  • Recommendations are guidance, not guarantees
  • You are responsible for final size selection

18. MISCELLANEOUS

Entire Agreement: These Terms, together with our Privacy Policy and Refund & Return Policy, constitute the entire agreement between you and Busty & Beyond.

Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

Waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it later.

Assignment: You may not transfer your rights under these Terms. We may assign these Terms to a successor business.
